2. Eligibility

The Platform may be used by individuals who are legally capable of entering into a binding agreement under applicable Indian law.

By using the Platform, you represent that the information provided by you is accurate and that you have the legal capacity to use the Platform and enter into any transaction arising from your interaction with Pushpam Infra.

Where a transaction involves the purchase or allotment of a property, plot, villa, second home or other real-estate asset, the eligibility and documentation requirements applicable to that transaction shall be governed by the relevant project documents and applicable laws.

3. Website information and project representations

The information available on the Platform is provided for general information and reference purposes. Information relating to our projects may include, among other things:

• Project layouts and plans
• Plot or property sizes
• Floor plans and specifications
• Elevations and architectural designs
• Photographs and videos
• Artists' impressions and renders
• Amenities and facilities
• Location and connectivity information
• Nearby landmarks and distances
• Proposed infrastructure and developments
• Prices and payment plans
• Availability and inventory
• Rental or return-related information
• Project timelines and development schedules

Such information may be based on information available to Pushpam Infra at the time of publication and may be subject to change due to approvals, development requirements, market conditions, regulatory requirements or other factors. Images, renders, illustrations and photographs used on the Platform are for representation purposes and may differ from the actual development.

Actual project specifications, dimensions, landscaping, amenities, facilities, finishes, layouts and other features may vary, subject to applicable approvals and project documentation.

Location distances, travel times, connectivity information and references to proposed roads, airports, highways, railways or other infrastructure are indicative and should be independently verified by the User.

Nothing on the Platform should be interpreted as a guarantee or assurance of future infrastructure development, appreciation, resale value, rental income or investment returns.

4. No offer or contract

Information published on the Platform does not constitute an offer, invitation to offer, allotment, agreement for sale, investment advice or any other legally binding commitment by Pushpam Infra.

Submitting an enquiry, registration form, expression of interest or referral form does not constitute a booking, allotment or purchase of any property.

A legally binding transaction shall arise only through the execution of the applicable documents and agreements between the relevant parties in accordance with applicable law.

Where there is any inconsistency between information published on the Platform and the applicable executed project documents, the executed project documents shall prevail.

5. RERA and project documentation

Where applicable, Pushpam Infra's projects are registered under the Real Estate (Regulation and Development) Act, 2016 ("RERA") and the applicable MahaRERA regulations. The relevant RERA registration number and project details may be provided on the respective project website or project communication.

Users are encouraged to independently verify the project's registration, approvals and other statutory information through the official MahaRERA portal and other relevant authorities.

All rights and obligations relating to a particular project shall be governed by the applicable project documentation, including the allotment letter, agreement for sale and other documents executed between Pushpam Infra and the purchaser. Nothing contained on the Platform shall be construed as overriding any statutory requirement or the rights and obligations contained in the applicable project documents.

6. Prices, availability and project changes

Prices, inventory, availability, payment plans, offers, specifications, amenities and other project information displayed on the Platform are subject to change without prior notice. Any price or availability displayed on the Platform should be treated as indicative unless specifically confirmed by us in writing.

Applicable taxes, stamp duty, registration charges, maintenance charges, statutory charges, government levies and other applicable costs shall be payable by the purchaser as specified in the relevant project documents.

Pushpam Infra may, subject to applicable laws, approvals and project documentation, make changes to project plans, specifications, amenities, designs, schedules or other project features.

7. Enquiries and communication

When you submit an enquiry or provide your contact details through the Platform, you agree that Pushpam Infra and/or its authorised representatives may contact you regarding your enquiry, project information, products, services or related offerings through telephone calls, SMS, email, WhatsApp or other appropriate communication channels, subject to applicable law.

The submission of an enquiry does not guarantee availability of a particular property, plot, villa, unit, offer or price. Your Personal Data will be handled in accordance with our Privacy Policy.

8. KYC and documentation

For certain transactions, including property purchase, booking, allotment or payment, Pushpam Infra may require the User to provide Know Your Customer ("KYC") and other documentation as required under applicable laws and internal procedures. This may include, where applicable:

• PAN
• Identity and address proof
• Bank or payment details
• Proof of residence
• Corporate or entity-related documents
• Other documents required for completing the transaction or complying with applicable law

The User represents that all documents and information provided are true, accurate, complete and valid.

Pushpam Infra may undertake reasonable verification of the information and documents provided and may refuse, suspend or terminate a transaction where the information or documentation is incomplete, inaccurate, fraudulent or cannot be satisfactorily verified. Any Personal Data collected as part of KYC or transaction-related processes shall be handled in accordance with applicable law and our Privacy Policy.

9. Payments, bookings and cancellations

Where online payment, booking or other payment facilities are made available through the Platform, such transactions may be processed through authorised payment gateways or service providers. Users shall provide accurate payment and billing information and shall use payment instruments lawfully belonging to them or which they are authorised to use.

Any booking amount, payment schedule, cancellation, refund or forfeiture shall be governed by the applicable project-specific terms, booking form, allotment letter, agreement for sale or cancellation/refund policy. In case of any conflict, the applicable project documents shall prevail.

Pushpam Infra shall not be responsible for delays or failures attributable to third-party payment gateways, banks or payment service providers, subject to applicable law.

10. Channel partner registration

Where Pushpam Infra provides a channel partner registration facility:

• Submission of a registration form does not automatically constitute empanelment.
• Empanelment shall be effective only upon confirmation by us.
• Channel partners shall provide accurate PAN, RERA registration details, firm information and other documentation requested by us.
• Channel partners shall comply with all applicable laws and regulatory requirements.
• Channel partners shall use only information, creatives and claims approved by us.
• No channel partner may make unauthorised promises, representations, guarantees or commitments on behalf of us.
• Commission eligibility and payment shall be governed by the applicable channel partner policy and agreed terms.
• We reserve the right to suspend or terminate channel partner empanelment in case of violation of these T&C, applicable law or channel partner policies.

11. Referral programme

Where Pushpam Infra operates a referral or "Refer & Earn" programme, participation shall be subject to the applicable programme terms. Unless otherwise specified:

• A referral must be a genuine new lead.
• A person who is already registered with us, already in an active sales process, or already introduced through another source may not qualify as a new referral.
• Self-referrals may not qualify.
• Where the same individual is referred more than once, eligibility shall generally be determined based on the first valid referral recorded in our records.
• Referral rewards shall become payable only after the applicable eligibility, booking, payment and other conditions have been fulfilled.
• Applicable taxes may be deducted as required by law.
• We reserve the right to modify, suspend or discontinue a referral programme in accordance with applicable law.

12. Intellectual property

All rights, title and interest in the Platform and its content, including the Pushpam Infra name and logo, project names and logos, photographs, videos, renders, illustrations, architectural designs, text, graphics, layouts and other materials, belong to Pushpam Infra or its respective licensors.

The User is granted a limited, non-exclusive and non-transferable right to access and use the Platform for personal and lawful purposes. The User shall not reproduce, modify, distribute, publish, transmit, commercially exploit or create derivative works from any Platform content without prior written permission from us. Unauthorised use of our intellectual property may result in appropriate legal action.

13. Third-party links

The Platform may contain links to third-party websites or platforms, including project-related websites, social media platforms, mapping services, video platforms, payment gateways and official regulatory websites. Such links are provided for convenience and reference. Pushpam Infra does not control and is not responsible for the content, availability, accuracy, security or privacy practices of third-party websites. The use of third-party websites is subject to their respective terms and privacy policies.

14. Platform availability

Pushpam Infra endeavours to maintain the availability and proper functioning of the Platform. However, the Platform may occasionally be unavailable due to maintenance, technical issues, system failures, network interruptions or circumstances beyond our reasonable control. We do not guarantee that the Platform will always be available, uninterrupted, secure or free from errors. Pushpam Infra shall not be responsible for losses arising solely from temporary unavailability of the Platform, to the extent permitted by applicable law.

15. User responsibilities and restrictions

The User agrees not to:

• Violate any applicable law or regulation while using the Platform.
• Use the Platform to submit fraudulent, misleading, defamatory, obscene or unlawful content.
• Infringe the intellectual property, privacy or other rights of Pushpam Infra or any third party.
• Attempt to bypass or compromise the security of the Platform.
• Use automated systems, bots, crawlers or similar tools to extract or collect Platform data.
• Use Platform content to falsely imply an association, endorsement or partnership with Pushpam Infra.
• Upload malicious software, viruses or harmful code.
• Use the Platform for activities that may damage, disrupt or compromise its operation.

Pushpam Infra reserves the right to remove unlawful or unauthorised content and restrict access where necessary.

16. User information and representations

The User is responsible for ensuring that information submitted through the Platform is accurate, complete and current.

Pushpam Infra may rely on the information provided by the User for responding to enquiries, processing applications, registrations, bookings, referrals or other interactions. If information is found to be false, fraudulent, misleading or materially incomplete, Pushpam Infra may reject, suspend or terminate the relevant request, registration or access, subject to applicable law.

17. Disclaimer

The Platform and its content are provided on an "as is" and "as available" basis. While Pushpam Infra makes reasonable efforts to maintain accurate and updated information, we do not warrant that every piece of information published on the Platform will always be complete, current or error-free.

Information relating to property prices, availability, specifications, project timelines, rental potential, market conditions, appreciation, future infrastructure or other projections should not be relied upon as guaranteed outcomes.

Real-estate purchases involve financial and other risks. Users are advised to conduct their own due diligence and obtain independent legal, financial, tax and other professional advice before entering into a transaction. No information provided on the Platform should be treated as investment, legal, financial or tax advice.

18. Indemnity

To the extent permitted by applicable law, the User agrees to indemnify and hold harmless Pushpam Infra, its group companies, affiliates, directors, employees, representatives, agents and service providers from claims, losses, liabilities, damages, costs or expenses arising from:

• The User's violation of these T&C
• False, inaccurate or fraudulent information submitted by the User
• Unauthorised use of the Platform
• Violation of applicable laws or third-party rights
• Unauthorised use of Pushpam Infra's intellectual property

19. Limitation of liability

To the maximum extent permitted by applicable law, Pushpam Infra shall not be liable for indirect, incidental, special or consequential losses, loss of profits, loss of opportunity or other similar losses arising from the User's access to or use of the Platform or reliance on information published on it.

Nothing in these T&C shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law, including rights and obligations arising under RERA and applicable project agreements.

20. Termination or restriction of access

Pushpam Infra may restrict, suspend or terminate a User's access to the Platform where the User violates these T&C, applicable law or uses the Platform in an unauthorised or fraudulent manner.

The User may discontinue using the Platform at any time. Termination or discontinuation of access shall not affect any rights or obligations that have already arisen under applicable project documents, agreements or law.

21. Force majeure

Pushpam Infra shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, floods, earthquakes, fires, epidemics, government restrictions, war, civil disturbances, strikes, technical failures, infrastructure disruptions or other events of force majeure, subject to applicable law and the terms of the relevant project documents.

22. Changes to these terms

Pushpam Infra reserves the right to modify, update or amend these T&C from time to time. The revised T&C will be published on the Platform with an updated "Last Updated" date. Users are encouraged to review these T&C periodically. Continued use of the Platform after publication of changes will constitute acceptance of the revised T&C, to the extent permitted by applicable law.

23. Governing law and jurisdiction

These T&C shall be governed by and interpreted in accordance with the laws of India. Subject to any dispute-resolution mechanism or statutory remedy available under applicable law, including RERA, the courts and competent authorities at Pune, Maharashtra shall have jurisdiction over disputes arising from or relating to the use of this Platform.

24. Severability

If any provision of these T&C is found to be invalid or unenforceable by a court or competent authority, that provision shall be modified or excluded to the extent necessary, without affecting the validity and enforceability of the remaining provisions. The failure of Pushpam Infra to enforce any provision of these T&C shall not constitute a waiver of its right to enforce that provision in the future.
